Youth Protection Ordinance

It is unlawful for any minor under the age of eighteen years, who is subject to compulsory education or compulsory continuation education to be or remain upon the streets, highways, roads, alleys, playgrounds, parking areas, or other public grounds, public places, public buildings, school property to which they are not assigned, places of amusement and eating places, vacant lots or any unsupervised place during the hours for which said minor is normally assigned to his or her school on days when said school in session (between the hours of 7:30 am and 2:30 pm).

Exceptions

  • When the minor is accompanied by a parent or guardian.
  • When the minor is on an emergency errand directed by parent or guardian.
  • When a minor is coming to or from work or medical appointment.
  • When the minor is in possession of a valid off grounds pass.
  • Emancipated minor.
  • When the minor is authorized to be absent from school on provisions of California Ed Code section 48205, or any other applicable state of federal law.
  • When a minor is going directly to or from an event or activity that is directly related to any medical condition of a parent of other adult person having care and custody of the minor.
  • When the minor is exercising his/her First Amendment Rights, such as free exercise of religion or speech

Procedure

When said minor is in violation of the Youth Protection Code they will be issued a traffic citation for the violation of Fremont Municipal Code 3-16200.

Penalties

  • First offense: $75; with court fees $286
  • Second offense: $150; with court fees $500
  • Third offense: $250; with court fees $800
